Online Store Rules - valid from 30.11.2021:
Terms and conditions of sale in the Cotec.pet Online Store
§ 1. Company details
The owner of the Cotec.pet Online Store operating at http://cotec.pet is: ADOT Sp. z o.o., ul. Partyzantów 11, 41-200 Sosnowiec, NIP: 6443512386 hereinafter referred to as: the ,,Seller".

§ 2. Preliminary provisions
These Rules are addressed to Consumers, Consumers-Entrepreneurs and Entrepreneurs and define the rules and procedure for concluding a Distance Sale Agreement via the Online Store.
§ 3. Definitions
Customer - any entity making purchases via the Online Store.
Consumer - a natural person concluding a contract with the Seller as part of the Online Store, the subject of which is not directly related to its business or professional activity.
Seller - ADOT Sp. z o.o., ul. Partyzantów 11, 41-200 Sosnowiec, NIP: 6443512386.
Entrepreneur - a natural person, a legal person or an organizational unit that is not a legal person granted legal personality by a separate law, performing on its own behalf an economic activity that uses the Online Store.
Entrepreneur - Consumer - a customer who is a natural person, carrying out a business on their own behalf, purchasing a Product inthe Online Store which is not directly related to the subject of business activity, made available on the basis of the provisions on CEiIDG.
Sales Agreement - a sales contract concluded at a distance with the Customer as part of an organized system of concluding distance contracts (as part of the Online Store), without the simultaneous physical presence of the parties, with the sole use of one or more means of distance communication up to and including the conclusion of the contract.
Online Store - online store run by the Seller at the Internet address www.cotec.pet
Product - a movable item available in the Online Store which is the subject of the Sales Contract between the Customer and the Seller.
Registration form - a form available in the Online Store that allows to create an Account
Order Form - an interactive form available in the Online Store that allows to place an order, in particular by adding Products to the electronic basket and defining the terms of the Sales Contract, including the method of delivery and payment.
Customer Account - means a panel individual for each Customer, implemented on their behalf by the Seller, after the Customer has set up the account and thus concluded the contract for the provision of the Customer Account service.
Business Day - each day from Monday to Friday excluding statutory holidays in Poland.
Rules - these Online Store rules.
§ 4. Technical requirements
To use the Online Store, including browsing the Online Store's assortment and placing orders for Products, you need:
- end devices with access to the Internet and the latest web browser (such as Safari, Chrome, Microsoft Edge, Firefox), with Javascript enabled;
- an active e-mail account;
- cookies support enabled.
§ 5. Making a transaction
The customer may place an order via the Cotec.pet Online Store or send it to the e-mail address: [email protected]. Contact details of the Online Store can be found at https://cotec.pet/kontakt.
In order to place an order via the Online Store, select the Product(s) that are the subject of the order, and then click the "Add to cart" button.
Placing orders in the Online Store can be done in two ways:
- as a guest (without the need to create an Account in the Online Store)
or
- after logging in to the Cotec.pet website if an Account has been created in the Online Store.
Creating an Account in the Online Store requires filling in the Registration Form.
If the option of placing an order as a guest has been chosen, the Customer's personal data, telephone number and address to which the Product is to be delivered, and the address details for the invoice, if different from the delivery address, must be filled in manually in the Order Form.
In the next step, in the Order Form, indicate the type of delivery and payment method.
The Customer, after filling in all the required fields in the Order Form, by clicking the "order with payment obligation" button, concludes a distance sales contract with the Seller.
The prices expressed in PLN, EUR or USD are gross prices (including VAT). The prices of goods are binding at the time when the Customer places the order. If the Customer is entitled to a discount, the system may automatically (after logging in) convert the prices of goods in accordance with the value of the discount.
The Seller uses the special One Stop Shop procedure within the European Union and recognizes the VAT rates of the country to which the order is shipped. In the case of orders placed with shipment to a country outside the EU, the VAT rate will be 0%, however, the customer must take into account customs duties in the destination country (e.g. tax and duty). The Customer is obliged to be familiar with the import law of the country to which they order Products from the Online Store. The Seller does not cover any fees imposed by the customs office of the destination country.
Product prices do not include shipping costs, and if any, they shall be covered by the Customer. Shipping costs depend on the total value of the products and the country of delivery. The seller may also offer free deliveries according to certain criteria.
In the case of prepayment, the payment deadline is 5 days from the moment of placing the order.
After this deadline, the order may be automatically cancelled.
Products shown at promotional prices are available while stocks or the promotion last.
The following payment methods are available in the Cotec.pet Online Store:
- cash payment on delivery (only for shipments within Poland),
- payment by bank transfer to the Seller's bank account (prepayment),
- electronic payment / credit card via Tpay.com (only in Poland), Stripe.com or PayPal.com (prepayment).
Electronic payments are supported by:
- Krajowy Integrator Płatności SA with its registered office in Poznań at ul. Św. Marcina 73/6, postal code: 61-808, KRS: 0000412357, to the extent necessary to process the payment for the order.
- Stripe Payments Europe, Limited (The One Building 1 Grand Canal Street Lower, Dublin 2, Ireland).
- PayPal (Europe) S.à rlet Cie, SCA (RCS Luxembourg B 118 349), ("PayPal").
§ 6. Personal data in the Online Store
The Personal Data Controller is: ADOT Sp. z o.o., ul. Partyzantów 11, 41-200 Sosnowiec, NIP: 6443512386, e-mail: [email protected],hereinafter referred to as: the ,,Seller".
Please read our Privacy Policy, which is part of these Rules.
§ 7. Shipping or collection of ordered goods
Ordered goods can be delivered to the address provided by the Customer, or picked up in person at ADOT Sp. z o. o., ul. Partyzantów 11, 41-200 Sosnowiec. Deliveries to the customer are carried out by courier.
Order processing begins:
- on the first business day from the moment of placing the order, in the case of selected payment on delivery;
- on the first business day from the moment of crediting the Seller's bank account, in the case of a selected prepayment by bank transfer or payment card.
The shipping time of the order depends on the availability of products specified in the product description. The deadline for shipping the order, if the subject of the order is in stock, is up to 10 business days. If the Product is not available in the warehouse, the lead time will be agreed individually.
The Product availability date is given in Business Days and is counted from the start of processing the order. If a given product is not available in the quantity ordered, the Online Store will inform the Customer about this before the availability date. In the event of unavailability of the Product, the lead time may be longer, or it may not be possible to complete the order. The Customer may agree to extend the lead time, make changes to the products, or withdraw from the contract.
Products are delivered without defects, unless the product description provides for otherwise.
§ 8. Withdrawal from the contract and return of goods
The Consumer or the Entrepreneur-Consumer making purchases at the Online Store may withdraw from the order without giving reasons within 30 days from the date of releasing the item, in accordance with the provisions of the Act on Consumer Rights of 30 May 2014. This right does not apply to non-prefabricated items and items made to the consumer's specifications.
The Consumer or the Entrepreneur-Consumer may cancel the order by submitting a written statement. The model withdrawal form is included in the appendix to the Act on Consumer Rights of 30 May 2014.
In the event of resignation from the purchase, the Consumer or the Entrepreneur-Consumer is obliged to return the Product intact, without traces of use, to the store to the following address:

In the event of withdrawal from the contract, the contract is considered void.
In the event of withdrawal from the contract, the cost of shipping of the returned Product shall be borne by the Consumer or the Entrepreneur-Consumer. In the case of returning very large or heavy Products with a large weight or dimensions exceeding the dimensions of the parcels, the cost of return may be higher than the price of a standard postal parcel.
In the event of withdrawal from the Contract, the Seller returns to the Consumer / Entrepreneur-Consumer immediately, not later than within 14 days from the date of receipt of the declaration of withdrawal from the Contract, all payments made by them, including the costs of delivering the Product, except for additional costs resulting from the delivery method other than the cheapest standard delivery method offered by the Seller selected by Consumer / Entrepreneur-Consumer.
The reimbursement will be made by the Seller using the same payment methods that were used by the Consumer / Entrepreneur-Consumer in the original transaction, unless the Consumer / Entrepreneur-Consumer has expressly agreed to a different solution that will not involve any costs for them.
The Seller may withhold the reimbursement until receipt of the Product back or until proof of its return is provided to it, whichever occurs first.
The Consumer / Entrepreneur-Consumer should send the Product back to the Seller's address provided in these Rules immediately, no later than 14 days from the day on which he informed the Seller about the withdrawal from the Contract. The deadline will be met if the Consumer / Entrepreneur-Consumer sends the Product back within 14 days.
The Customer who placed the order declares that they have been informed about their right to withdraw from the contract in accordance with the Act referred to in the first indent of this paragraph.

§ 9. Complaints
In the event of a complaint, the Customer should contact the Customer Service Office:

If the Customer complains about the Product, the Online Store, considering the complaint, may require the Customer to deliver the complained goods to the store's warehouse located at: ADOT Sp. Z o.o., ul. Partyzantów 11, 41-200 Sosnowiec, with a proof of purchase and description of the complaint.
The Online Store will respond to the complaint within 14 days of filing the complaint and inform the Customer about further proceedings.

§ 10. Final provisions
The Online Store will try to resolve amicably any disputes arising during the implementation of orders.
Any possible disputes shall be settled by Polish common courts. The court's jurisdiction is governed by the relevant provisions of the Civil Code.
The consumer also has the option of using out-of-court dispute resolution. All disputes arising from the Sales Contract may be resolved before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection. To all matters that are not regulated by these Rules, the provisions of civil code and other appropriate acts shall apply.
We reserve the right to amend or supplement these Rules in order to comply with the law or the changing requirements of our business. Any changes will become effective 14 days after the publication of information about the changes on our website. You will be notified of the changes by e-mail sent to the address provided by you for contact purposes in your Account. Any changes do not affect the rights acquired by you under the previously applicable Rules. If you do not accept the changes to the Rules, you should stop using this Online Store.
